MS could make a sensor bar without breaking any patents. I can make a sensor bar legally. All you need is a pair of candles!
The sensor bar is nothing but a strip of LEDs that the IR camera in the wiimote looks for. The cord from the sensor bar sends zero information to the Wii itself so the 360 would have to communicate with the wiimote itself using bluetooth (which the 360 doesn't have I don't think) not its own sensor bar and that isn't going to happen as Nintendo would be all over them.
