In some parts of the world, it's not illegal to patch and mod your console to run homebrew on it, but the act of downloading games you don't own it's still illegal.

Is there any country you know of that prohibits you from modding your own HW as long as you don't break copyright material or divulgue the findings that lead others to breaking those materials? I don't remember any. But yes piracy is crime in most countries, just that in some no one care or take action against.
