Some companies allow modding. Some even support it (minecraft and gta). But there are also companies that are heavily against it. Companies that are heavily against it have their own servers to make sure cheating and hacking do not occur (ex: blizzard). Nintendo is definitely one against modding/hacking/cheating, so it would make sense for them to have private servers. That costs money and it wouldn't be surprising if nintendo as a CONSOLE maker to charge a yearly fee
