Seems like the issue is with the legislation if the only way to remove someone from office is via a jail term. Heck, they fired a prime minister in Australia.

US isn't Australia.  Different States have different laws regarding their elected officials, and unless the law is set at the Federal Level (which I doubt it is), even the Government is hesitant to get involved (unless it's a human/civil rights issue).  

They shouldn't have to either, her actions aren't about respecting her own faith, her actions are intended to force her faith onto others.  If that weren't the case, why wouldn't she just quit?
