Pretty sure whatever deal EA and Sony stitched up would have covered EA Access, so I doubt there is any contractual problems here. If Sony wanted to entice people so impatient that they want to play a game before its release date they could have arranged for an exclusive beta for all PS4 owners, which would happen before EA Access made the game available.
As an online multiplayer game I wonder whether EA Access will amount to much prior to launch. EA Access seems like something that is of much greater benefit as an early access portal for single player content.
