It is not what they did but what they can do.

It is against the law to make a product you brought unusable... you can ban / make unusable the services like PSN or Live but the console you can play retail games yet.

Etho, they where beta testers. They got a game early so they could test it, not leak it to the general public. This isn't DRM, this broke an NDA, and they can be sued for doing this. So yes it is legal to this, and I think Microsoft's judgement is right. I would say the same thing if Sony did this.
