Publishers/developers need to be held to account for making misleading claims. But an actual lawsuit that takes up court time, that is ridiculous and frivolous and the court should have refused to hear it out of hand. Let publishers be judged in the court of public opinion on this sort of thing, not waste the precious resources of the judicial system on matters which or inconsequential.
If people want to sue publishers for some of the shit they pull then sue them for producing buggy/broken games. resolution, aside from console/PC spec pissing contests, is meaningless.
