eShop> Settings/Other > Redownloadable Software. Once the dowload for a (free) SMB Deluxe game failed and NoE told me to go there and it worked. Hopefully it works for you!

Thanks, but i cant even log in my NNID because it is attached to my old 3DS, so I cant even access eshop...
I think by contacting to nintendo can solve this.

Go to settings and NNID settings. You should be able to use a existing one. Dunno about this one though....
