I don't understand why this is a problem for PS4/PC gamers though. People have paid for EA Access, and EA is living up to its end of the deal by giving subscribers early access to new games.
About the only thing you could say is a tad dodgy is the fact that Sony has an exclusive marketing deal and it could be argued this is a breach of contract because promoting the early access is promoting the Xb one version. However that's Sony's problem to deal with and if Sony doesn't think it's worth taking action then fans pretty much don't have a leg to stand on. Then again, when have some fans ever needed a leg to take a stand against the opposing platforms? If these people want early access to EA games then they should petition Sony to allow EA access on PS4.

Won't breach contract because the game is releasing first on EA Access. Not Xbox One. Xbox One just happens to be the only console to have EA Access.

That would be something for Sony's legal team to assess. It can be argued either way, and it might come down to how tight the wording of the marketing contract is. I'm sure EA's legal team gave EA an interpretation of the contract that said it would be OK, or at least very low risk. But there are always different ways to interpret a contract. If the marketing contract prohibited EA from doing anything that directly or indirectly promoted a different version of BFH then promoting the early access would be a breach, because it's indirectly promoting the Xb one version. But if the contract simply barred EA from referring to or using Windows, Microsoft or Xbox in their promotions then the early access promotion would almost certainly not be a breach.
