Forgive my laziness in not reading 26 pages, but... I shall reiterate my stance on it for the sake of... contributing of sorts 
"I mentioned on Twitter that I don't support the use of content without creative intent. If someone just posts videos of gameplay, then Nintendo has every right to shut that down.
The Fair Use act is there to encourage and protect creativity. If people are not doing anything creative with the work of others, then they are not doing any work, and hence should not make a penny."
