No, the DOD's own internal processes are being changed. Laws aren't changed on the basis of some shit the Secretary of Defense said, and it is the law that exempts women from the draft.

Getting congress to amend the law is part of the process. That's partly why it's going to take until 2016. The DOD is pushing congress in order to remove all barries to service.
