The USA can do what it wants and the same rules do not apply to the USA. Guantanamo Bay for instance treatment of terrorists or suspected terrorists, many held for long periods of time without charge and with no legal representation. Enemy conbatants/suspected terrorists received the special exception where normal rules of law do not apply and military can do what they want to prisoners: torture, sleep deprivation, starvation, interrogation, etc.
