I always wondered about certain things about returning games. I mean clothes, if you are unhappy with it and haven't worn it/damaged it, you can take it back and get a full refund. Buy a toaster and it breaks for no fault of your own in the first week from Argos and take it back for exchange or refund straight away. Yet with games, you can't? I dunno...
GAME's website says this on their Refunds and Returns page:
"• Faulty software, where the seal has been broken may be returned up to 3 months after the despatch date or 12 months if Preowned."
In other words, you bought MCC or Driveclub and it is faulty, take it back get a refund.
