I'm very curious to see if Sony will press action on Microsoft about this. Microsoft isn't clearly advertising the game with a picture, but they clearly post about the game in an ad and talk about how they can't advertise it. Even though it's not incredibly direct, it's still advertising the game.
Now i'm not a lawyer so I couldn't say for sure, but i'll be interested to see if it goes anywhere.
