Why not? It makes sense instead of having to dish out $40, I'm pretty sure they said they were going to add an upgrade option in. Pretty stupid that it was a limited time thing.

For the Ultra pack without the upgrade feature, yes. Unless he tries what I suggested and try calling customer support, I've heard some reports of them giving people refunds to upgrade.
