You don't own a game when you buy it physically, according to the EULA. You own a disc, but not the game itself that's on the disc.

Sony/Microsoft/Nintendo can terminate your ability to play the game through legal action, if they so wish. They aren't, but nor are they for digital games, so your point is invalid. 

It's easier to terminate the digital service denying you the game. VS going to court and phsycially removing the game from your home.

Except no one is terminating anything, unless you're engaging in illegal activity on your account. They can brick your console if they so wished through an update, they don't do that either. A lot of this is baseless paranoia. 

You don't know that and It's not baseless. Hell Kiki Wolfkill of 343 wanted people perma banned from XBL for using sexist slurs. Networks are not stable and they will never be fully secure. They could easily be hacked and the data could be lost or someone could lock out every person on the network. A petty person could find themselves in a position of power, lose their shit and indiscriminately permaban people locking them out of their games.Its not the first time something like that has happened. Sure they can brick your console but it's easy as hell to flash the drive and load up your own OS. So you can still play your disk based games. Something you can't always do when your game is locked away in some not-completely-secure server somewhere that is guarded by some fallible human being that is one powertrip away from denying you access to your game.

In 2011 how many people got locked out of their accounts and lost access to their games when Sony got hacked? A lot of people lost their personal info. I'm sure it was a lot of em. Hell it was far worse for XBL Gold. Since the launch of Xb360 and even for some time on Xb1 people had their accounts hacked into every day. A lot of them losing access to their digital games. Why? Because of a well known exploit(in the hacking community at least) that allowed people to bypass password verification by pressing space bar. For years Kotaku and other outlets reported on the high number of accounts being hacked into that ranged from celebrities to Xbox employees. For years they blamed it on phishing and user error. It wasn't until a 5 year old discovered it that they acknowledged it and did something about it. I'm sure after a lot of hassle and dealing with customer support they got their accounts back.

However we have consumer rights. Rights that people fought and died for for generations. One of those rights is to not have to worry about that kind of hassle or have that kind of of fear of you losing access to something you paid for. You have to acknowledge and accept that there is serious and very real risk involved, otherwise you are being blind and irrational and one day you will be filled with enormous regret when something bad does happen.

People could rob your house and you can lose your games, or your house could burn down and you'll lose your games.

You could also comitt a crime and be locked away, not being able to use your games.

There's a huge risk to everything that we have just by living. If you are stupid enough to use slurs or be an asshole while playing, yes, you might be banned. Usually you won't be perma-banned for something trivial, but if you do something so inherently stupid you might. 

This isn't a conspiracy about a company taking away consumer's rights. Any game you had downloaded would still be available for you to play, even then. You just wouldn't be able to redownload it. And Sony/Microsoft could patch your system to prevent it from playing a certain game if they so wished. They aren't, so there's no reason to make this into a conspiracy.
