The ad says at the end that Kinect is sold separately, so by default, they are doing the right thing and the ad is not misleading at all.

it's in small print and lasts a second. if that was on TV all you would see is the $399 price tag, which is also the only thing they say. So anyone with any kind of seeing problem likely won't see it.
