Probably the parity clause. Primarily because MS is now negotiating from a position of weakness as far as securing developers and their titles.
When lagging behind by such a significant margin this early in the game, you're really in no position to be placing demands and restrictions on potential partners, particularly when the current leader is doing everything in their power to secure as many titles as possible by creating as favorable a distribution platform as possible to developers.
