The FCC would determine on a case by case basis if the terms of preferential treatment negotiated by ISPs and content providers are “commercially reasonable.”

Meaning the harder you lobby them, the more leeway they'll give you. That should create a competitive market environment which will be great for consumers!

In a sense it's better because it seems to be trying to address the notion of throttling face-forward, rather than how it's been dealt with in the past.

It all depends on the specific criteria they lay out. Basically the more specific they are, the more likely this is to be on the up-and-up.

We'll just have to see.
