When the hardware is no longer supported by the manufacturer. To a lesser degree, when a game goes out of print and the publisher ceases to support it.
That's probably not the answer freeloaders want to hear.
Game collectors and retro gamers will want the original packages anyway and will hunt down whatever old hardware or game copies they have to because they want them even if they never play them again, so retail availability is not really an issue.
But for those who just want free entertainment, stop trying to justify your actions or rationalize when it's okay to pirate and just do it. Don't rationalize. Just admit you want something for nothing and you'll probably feel a lot better about it if you choose to make piracy an ethical decision.
