If they're accepted into ID@Xbox, yeah. Sony seems pretty free with handing out kits if they're keen on your game, though, so it's more or less the same thing: free dev kits at the platform holder's discretion.

Well id@xbox is where the parity clause is.  Indies can publish without being the program, at least eventually they will.  I think the catch is that you cant self publish without being the id@xbox program.

either way, if parity or self publishing is that important to the indie developer, then chances are they dont have the resources to make a game anybody will give a damn about.  All this complaint is is just one more point blown out of proportion for the sake of the console wars.
