I woud certainly be in favour of enshrining the consumer's right to re-sell digitally distributed content. However it would have to be at full price because unlike disc based content where disks can become scratched, or game cases get a bit manky the digital product does not deteriorate at all. and if you re-sell a game that is exactly the same as the game that is newly purchased then that obviously undercuts new purchases and thereby hurts publisher revenue even more than used disc game sales. Either that or if there's a secondary market on Steam/PSN/XBL/Origin then the publisher gets a cut of every sale through that market as well. That way everyone benefits from the secondary market.
