Without throwing a lot of legal language that will confuse our other users. First-murder would be murder with intent, while second degree is 'ordinarily defined as 1) an intentional killing that is not premeditated or planned, nor committed in a reasonable "heat of passion"' so that's why I think the guy deserves second degree. It seems there was reasonable "heat of passion" as misplaced as that passion may have been. Loved his xbox more than his kid for a moment there. Disgusting, but apparently that is what happened. |

low jab? Thats one of the excellent benefits of the xbox! I play my 360 lots on cold winter nights because it heats up the place a few extra degrees. Maybe they didn't have proper heating and the guy was pissed their only source of heat was broken.
