Without throwing a lot of legal language that will confuse our other users. First-murder would be murder with intent, while second degree is 'ordinarily defined as 1) an intentional killing that is not premeditated or planned, nor committed in a reasonable "heat of passion"'

so that's why I think the guy deserves second degree.

It seems there was reasonable "heat of passion" as misplaced as that passion may have been. Loved his xbox more than his kid for a moment there. Disgusting, but apparently that is what happened.


and for once, the "heat" wasn't from lack of cooling and overheating motherboard. At least Microsoft is off the hook!

 low jab? Thats one of the excellent benefits of the xbox! I play my 360 lots on cold winter nights because it heats up the place a few extra degrees. Maybe they didn't have proper heating and the guy was pissed their only source of heat was broken.
