Ok, I am going to take a different stance on this...
No, I don't think Nintendo should allow this. Why?
Because people will bitch, and it is Nintendo's tradition not to be the first to do something that will make people bitch. There a company and there job is to make money. This game will not make them any money.
Secondly, the developer should release it on PC. Free market capitalism and all that. (It will still sell bad).
Lastly, Holocaust survivors and historians should make a huge deal out of this (nothing) to get attendance up at Holocaust museums.
I would cite regulation, but I know you will simply ignore it.
