Its not that hard to understand. Microsoft didnt come out defending themselves. Machinima came out and was honest and said it was their contract between them and their Content Providers. Why would Microsoft be involved in another companies contracts?

The question how did microsoft not know about 'the other companies contracts' that benefited MS more than the 'other company'

we will never know for a fact, but I dont believe it for a second that machinima acted in the interest of MS without them knowing or benefiting in any way from it.
