You clearly aren't aware of the numerous shady business practices that Nintendo has used to its advantage. To suggest that they're trying to protect gamers or the industry is laughable.

They're protecting themselves and the market's viability in the long-term. EA only think about next quarter's results.

Suppose 3D World released on phones for $5. Would it make next quarter amazing? Yes. But Nintendo wouldn't be able to continue to sell their Mario games at $60 on a $300 console. Even with all the investor and media pressure, Nintendo know it would ultimately damage themselves to go to smartphones.
