Going with XB1 if your plan is to go "all digital" is a dubious choice given the non-upgradable internal HDD. Sure, the XB1 is rumored to have installation support on external drive in the future, but until that's an actual thing, why would anyone use what may happen as their reason for choosing a platform?
And I can guarantee MS' policy towards hardware hacking is no more lenient than SCE's. Count on it. Banned account, loss of any legitimate purchases once detected. And if the idea was to use pirated games, I don't think either MS or SCE would be sad to lose your "business."
If you're having issues with e-payments, there are, as people have been point out, ways around them, but it sounds like you've already made up your mind.
Stick with PC if it's an issue and forget about the console exclusives if your perceived consumer rights mean that much to you.
And as convenient as it may be to have games pre-installed on console, currently, one is better off buying games on discs so they can easily install and re-install games if deleted without having to redownload them as games approach 30+GB.
