You cant play games without it, and reviewers have probably had to have the update in order to review the game.

Ah, so it was probably a temporary patch that enabled the console for reviewers maybe?  Sucks that the guy was banned though, defeats the whole point of getting the x1 early.  Maybe he should have kept his his mouth shut
