either way, I think it's a lost cause if capcom tries the lawsuit. for example: mario defined the platform genre but that doesn't mean any game where a character jumps on enemies and goes from point A to B is a copy that can be sued. there are two factors that allow a company to sue another for plagiarism:

1- Art style/sprites that are basically copy pastes with a few changes.

2- copy of level design, as in: a game that looks different but plays the same, with platforms, enemies and whatever located on the same place of the copied game's level design.

Mighty no 9 isn't doing neither of those.

Never know what would happen.  You had Sony suing Jerry Lambert for looking like Kevin Butler, and attempting to appear in another ad featuring another videogame.  Sony claimed they sunk a lot of money into building up the Kevin Butler brand.  People are now going with Mighty No 9, that "it is the next Megaman", so Capcom can argue that Might No 9 is damaging their Megaman character, inb the way of the Kevin Butler angle.

Considering how much Capcom is off here, and desperate, I wouldn't be surprised if they do attempt to sue, and try to get something out of it.  Since they apparently aren't listening to their fans, saying doing that would harm their fanbase so they wouldn't, isn't a lock.
