I'm not sure if anyone has addressed this or not, but I'll take a stab.
Does the problem happen with disc-based, or downloaded games (games installed to the HDD to not count), or both?
Does the problem happen if you remove the HDD and use a USB thumb drive or a memory card?
If the problem happens with both types of games, and doesn't happen if you remove the HDD, then you have a bad HDD. If you don't have the means to test if the HDD is a problem you may want to pick up a 4-16GB USB memory stick and test it. With the HDD installed, format the USB thumb drive, copy your profile to it, then copy a game to it. It's possible you may need to download the game directly to the USB thumb drive. Next, remove the HDD while the console is powered off. Restart the console with the USB thumb drive in, and test it.
If the problem is not exibited when running a game via the DVD only or from the USB thumb drive with the HDD removed, then the HDD is the problem. You'll need to replace it. Microsoft won't.
The reason why Microsoft may not be able to duplicate your problem is possibly because you typically don't sent in your HDD with a console repair. Not to mention, they don't repair HDDs.
I've only ever had Microsoft send me back a console once saying they couldn't duplicate the problem, but oddly enough the console I got back had a different serial number on it and the problem was fixed.
