Nintendo didn't make the copies, Gamestop did.

... Eh? Gamestop actually manufactured brand-new Nintendo games...? How did that come about? Do they have factories? :s

Well, anyway, even if they did, I'm pretty sure they couldn't have done so without Nintendo's cooperation.

They payed a different company to produce the games, forgot the name of it.  Nintendo hasn't commented on the situaion so still have to see what their gonna do.
