Well, here's the thing.  Cellphones are triangulated between towers, so anytime you turn it on, your position can be tracked.  Smartphones, have GPS, and your position can be identified within feet.  Smartphones, where the battery can't be removed, are constantly sending data out.  This is a known fact.  If anyone wants to know where you go, they can.

That said, the Xbox One is using minimal power when its in standby mode.  Does your laptop operate in standby mode?  Is it able to record video or voice conversations?  No.  Neither is the Xbox One.  Instead of sitting there waiting for an input from a mouse or keyboard, it's waiting for an input from Kinect.  When Kinect hears "Xbox On" then it signals the Xbox One to turn on. 

Last I knew, they didn't put a HDD in the Kinect sensor, so it can't do much more than listen for an exact phrase and when it hears it, then provide the input to wake the Xbox One.

First off, I don't really care if the xbox one is recording what I'm saying, it's not like I'm saying anything the gov't cares about. Second, I know that there is a very low chance the xbox one is "always listening." Third, there has to be a microphone constantly listening for the "xbox on" prompt, so some people are scared that it could be recording it. 

The first two aside, I recognize the third, however the mic is listening for "Xbox On".  There is enough power for Kinect and the Xbox One to respond to the "input" from Kinect.  Much in the same exact way that a laptop or PC in standby, when the mouse is moved, starts up.  There is enough power to power the mouse, which sends an electrical signal down a wire, that activates the power circuitry, that turns powers up the computer.  The difference here, with Kinect, is that Kinect is powered and listening.  When it hears "Xbox On" it sends that signal down to the Xbox One, where it activates the power circuitry, and that in turn activates the the console.

It can't record.  Not while it is in standby mode.
