Yes that is also my opinion.
in fact when the Xbox one is off:
1) It cannot acces to the hdd as it will take much more power in stanby mode so it can't record.
2)It cannot use the network to send data for the same reason.
3)And if it were to track and record data it will be a day one scandal since you'll only have to install Wireshark on your pc and watch paquet on your subnet. If the One communicate data while off you will know instantly.
when on, it will not be able to stream video or audio for the same reason as no 3 and because it will use too much bandwith anyways.
The only kind of data it will send are game related data (reaction, emotion, heartbeat ), those data may be use to create more intense user experience in future video games. But the privacy settings will prevent those data from being sent if you don't want.
