Depending on your interests and if you own a DS yet or not, then yes or no.

Prior to the XL version coming out, I'd have said no regardless as there weren't any games good enough and the original 3DS sucks ass. The 3DS ergonomics suck and it's easily the most uncomfortable handheld I've played. Is it that hard to make a comfortable handheld Nintendo? Until the XL(and maybe the DS XL, but I've never used it,) you haven't made one comfortable handheld since the original GBA.

If the person didn't own a DS. Then yes. Get an XL and get all the great DS games you're missing first, then get 3DS games here and there..

If the person has already owned a DS, then prior to February I would have said no. The games that are constantly praised as some of the very best on the system aren't even among the best exclusive portable games between the Vita and 3DS.

February and beyond I'd say yes, but only if you have atleast a mild interest ini RPGs. Tales of the Abyss and Devil Survivor Overclock are already on other systems, so the first good exclusives on the system are Fire Emblem and Etrian Odyssey 4, Soul Hackers having came out in April, SMT4 coming out this month, while Bravely Default, and the Etrian Odyssey remake coming out closer to the end of the year. Crimson Shroud came out in December, but I won't tell someone to buy a system based on a digital title. There's also Project X Zone which I wouldn't have put anything down on it being good, and from the reviews, even the ones that do score it high, it has some pretty bad flaws.

So why would I base a purchase on two games and others coming out in the future? Because there are few RPGs that are released these days, fewer still that are good RPGS. Handheld RPGs have been better than console RPGs on average.

The mildly interested in RPGs part because there are some good games on the 3DS. Cave Story 3D is the only really standout great title. Lords of Shadow Mirror of Fate, Super Mario 3D Land, Kid Icarus(maybe, never played this,) are fairly good games I'd say getting because you own the system, not something you should buy the system for. There's really nothing else that I'd say waste your money on.

If the person was looking for a more diverse library of games, I'd have recommended the Vita. Right now I'd say the 3DS are Vita are on equal footing, but once SMT4 comes out the 3DS will be the better portable until. September and beyond, Vita has a lot of good looking exclusives.
