It would have still had a second-hand market. Microsoft was working out those details. You would have been able to go into a retailer and trade-in a used game and you would have been able to "gift" your game to someone. The latter wouldn't have precluded you negotiating with the person for a fee to do that gifting (i.e. they buy it off you).
