As far as I know, no. I don't believe Comcast has any say in who has access to its programming list. In the US I'm pretty sure it's a central clearing house that provides those lists, but you have to subscribe to each market for each provider. It ends up being a lot of markets.
That is, of course, here in the US and probably Canada. In other parts of the world there may or may not be a central subscription service for which Microsoft can subscribe. Otherwise, it would need to obtain that programming information through the provider itself.
In a manner of speaking yes, without it you could still watch live TV. I believe you'd still be able to change the channel, by saying "Channel 6" for example, but the OneGuide wouldn't be able to provide you with programming information, or determine the content you like and make recommendations.
