Look, the whole MS banning issue has been overblown as it is.  There's no need for additional mudslinging.  Or at least if you must do so make sure you hit the right target.  These are ToU for PS websites and have nothing to do with PSN.

Not the same thing. The thing about websites says they can terminate access for any reason. The thing you've bolded about PSN access is saying that you won't get any refunds if PSN service is terminated and it doesn't matter the reason for termination. The PSN termination thing is poorly worded and it is open to exactly your misunderstanding. Better wording would be: You will not receive a refund for items.... if your account is terminated, regardless of the reason for the termination of your account.

But it doesn't matter much. Any games you have on your HDD that don't require you to sign in to your PSN account to play will still be playable. Same with any games you bought on disc.

You should also note that not getting refunds is also part of MS TOU for XBL: You should refer to the offer describing the Services as (i) you may not receive a refund at the time of cancelation; (ii) you may be obligated to pay cancelation charges; (iii) you may be obligated to pay all charges made to your billing account for the Services before the date of cancelation; or

So industry stadnard stuff for the most part.
