MS is using a Nvidia Titan in their X1 units at E3. Are they mis representing the X1 graphics.

Possibly.  I would imagine this would fall under false advertising.  Maybe not if its just the E3 games that look better than the final game.  But, possibly if the E3 games are used for their ads, yet the final games don't look as good.  I do know SE was forced to take down their FF13 ad for the 360 version, since it used PS3 footage and there was a discernable difference in visual quality.
