Um yes they can. When you play an online match of CoD, do you think you are connecting to Sony servers? No. You are connected to the Activision servers. When you insert a disk on the PS4, that disk belongs to the third party company.
Do you think EA online passes connected you to the Sony servers? No, you connect to the EA servers. Sony can't stop third parties from doing it, simple as that.
