If Sony refuses to implement system wide drm, publishers can always implement it themselves: online activation via product key, online checks when starting the game. And you'll end up with an EA account, Ubisoft account, etc. In that case Microsofts' system wide drm system suddenly starts looking better, offering easier installation and at least some, albeit mutilated, form of second hand sales.

Of course those publishers might think twice. They'll obviously be excluding offline console users, and it will give others, like CDProjekt, a chance to steal the spotlight.

Yes the online checks are only neccesary if you want to start the game on a different console with the same account. Same as it is now with xbla. (Or if they want to offer a similar trade in scheme to xbox one)
