No, but they could just say no or don't do it again. If they actually love each other or at least like each other, I doubt that anyone would consider it rape. They would probably find it funny. especially if the one asleep still did not wake up.

Ehh, I wouldn't marry a woman who thinks that that's rape. And asking in advance takes all the spontaneous and fun away from it.

However if after it happens she says no, then I would immediately stop.
