As far as I know Microsoft only said that one needs to pay a fee if one game is intalled on multiple consoles through the same disc. Because you you can play games without the disc (after intstallation) a fee of the full retail price (if it's new) is necessary for everybody but the actual owner.

If the owner chooses to "unlink" the game from his account somebody else can link it to his own account without any fees. This process would need an internet connection though. Some say that one is automatically "unlinked" if the game (the same disc) is installed on another console without the fee being paid.

Microsoft never said anything about used games, only that you are able resell your games, hence one is able to buy used games as well.
