This is patently false. The 5G games and 3G os space is a HARD WALL. No game can use more than 5G of ram. This was explained in one of the tech sessions after the XBox One reveal.

Since you didn't follow up, I did. 

Marc Whitten did NOT say anything.  He neither confirmed nor denied what amount of memory the Xbox One uses for games or for OS.  In fact, when asked if the OS would take up 3GB of RAM, he said "It could take more or it could take less."  Meaning there isn't a set amount of memory allocated to the OS or to games.
