I'm not even sure why this is a big deal. Kinect 1.0 worked like that last gen, Kinect 2.0 surely will. Not to mention the console responded in real time... It was live footage. Vgchartz over-reacting again.

Just the first thing that came to mind once I read the stuff about the old kinects 'malfunctioning'. Also, yes, like an off/on switch. Doesn't really matter if it was Push-to-talk or switching to off/on.
