Fair use allows you to legally make a copy - if you can. It doesn't mean that it has to be physically possible to do so. You see the fair use law is just saying it's not illegal to do so, it provides no provision for giving you access to actually make a copy.
So in effect it was designed to take the "wrong" out of doing so - that is all.
