That's the thing about the law. Different people interpret it different. And yes, they get it right sometimes, but sometimes they get it wrong, and when it's wrong, it can really do a whole bunch of damage. I can't see how any sane person would thinking taking rights away from a protected minority would ever be allowed in the USA - which is exactly what Prop 8 does.
Personally, I think Scalia, with what he has already stated, must recuses himself. But I don't think he has the integrity, fortitude or guts to do that.

Correct me if i'm wrong, but I thought the default was that prop 8 was dead and gay californian couples are already getting married due to the last court ruling saying it's not consitutional.

Yes, unfortunately, you are incorrect.
While, yes Prop 8 has been declared a violation of the US Constitution in two ruling of the 9th Circuit Court of Appeals, there is currently no way for a same sex couple to get a marriage license or legally married in California. The proponents of Prop 8 have managed to tie everything up in court and while couples can have a ceremony, they get none of the Civil Rights that come with marriage.
They kids do not get married parents, mixed national couples do not get to be together, they do not get the tax and inheritance benefits offered to opposite sex couples. Injustice is in full effect thanks to Prop 8.
So my friends that were together for 52+ years, died without being able to get married.
