Sony has the disc identifying technology on PS3 but didn't ban used games. They had that special gamer reward promotion thing where if you put a disc in the PS3, it could tell whether it had been used on another console before. So you were rewarded for buying brand new games.

Personally I don't see anyone banning used games. The negative reaction would just be too much to overcome. If you thought $599 RIIIIIIIIIIIIIIIIIIIIIIIIIDGE RACER was bad, yikes. The only way I could see someone making such a bad business move was if they had something bold in store for the new console. Like EA exclusive or something.
