Yes we know the franchise belongs to Epic. However there are a things called contracts. Microsoft doesn't just cut the check and get the games. There are deals signed and the speculation for a long time has been Microsoft has been locked into a new trilogy for the 720 for a few years.


Contracts can end and not be renewed.
Epic owns the IP and probably had a contract for 3-4 Games for the 360.
What if they couldn't find an agreement for a new contract and EPIC said "No we want to expand the franchise" ?
And the speculation always said that Cliffy B wanted Gears to go Multiplat a long time and so said some others at Epic.
The possibility is there if Microsoft isn't convincing enough.

And we have seen contracts getting broken in this Gen all the time or how "Ultra Exclusive NEVER on other platform" Games suddenly came to other platforms.
The Bungie Game "Destiny" was rumored a long time to be 360/720 Time Exclusive and even reports from Activision showed that and now the PS4 is getting the best version.SquareEnix broke the contract for Final Fantasy 13 with Sony cause Microsoft paid enough including the fee for breaking the contract.
There is always the option for 3rd Party to just break contracts if enough money is involved.


@ Gears - I really don't care.The first game was fun cause of the new experience.The 2nd already got boring and 3 was just completely uninteresting.Judgment won't even carried by its own fanbase as it looks like.
Would probably just be a nice punch from Sony into the face of M$ if it would happen.
