They could be giving PSVs out for free and the console still wouldn't threaten 3DS sales. I'm not even sure if Nintendo's first 3DS cut was retaliatory, but, at this point, Nintendo is plenty aware that there's not very much Sony can do to steal 3DS's thunder so they needn't acknowledge it.
