I guess biased moderators have something to do with that. A 360 fan gets banned for something which won't get nintendo/sony fans banned, because the fanbases of n/s are reporting everything which is even a bit negative towards their console of choice.
Then a moderator comes to rescue and bans. In some cases certain moderators look for excuses to ban users... not mentioning any names.
